Legal Issues for Libraries Series

From book challenges to interrupted drag story times and requests for pastor story time, Massachusetts libraries are experiencing unprecedented pressure to provide services safely and equitably. But what does this mean as it relates to established library law? When crafting and executing policies, libraries and trustees need to understand the legal concerns and precedent related to policies and providing access.

Dr. Tomas Lipinski will present on two topics: Library Meeting Spaces and Library Collections. Each topic will be presented twice, and will have time for Q&A.

These sessions will provide information on the constitutional framework courts use to determine the constitutionality of a government regulation. Library Meeting Spaces will focus on library cases involving the use of meeting rooms by patrons. Library Collections will focus on the extant law relating to content objections in libraries, both physical and online collections, and the immunity for online content when the library is a qualifying service provider under federal law.

It is recommended that people attend both sessions, or watch the recording for Library Meeting Spaces before attending Library Collections.
 

About Dr. Tomas Lipinski:

Dr. Lipinski (he/him/his) is Current Professor and former Dean of the School of Information Studies, University of Wisconsin Milwaukee where he teaches and researches in the area of information law and policy, especially those issues impacting libraries.  He is the author of numerous monographs, articles and book chapters. A forthcoming article (2023) entitled Navigating the Copyright Alternative in Small Claims Enforcement (CASE) Act in an Education and Library Environment (forthcoming) will be published in LIBRARY TRENDS. Professor Lipinski.  He also serves as Expert Advisor to the Copyright and Other Legal Matters Committee of IFLA and is the current Chair of the Subcommittee on Copyright of the  Copyright Legislation, Education and Advocacy Network (CLEAN) (https://www.ala.org/aboutala/committees/subcommittees/ala-lgcopyright).
